Hartline Dacus Barger Dreyer LLP successfully defends trucking company in wrongful termination case. - Fort Worth, Texas, August 21, 2014. Hartline Dacus Barger Dreyer LLP attorneys Edward A. Davis and Jim McInerny successfully defended a major trucking company in an employment case claiming the employer retaliated against the employee for filing a comp claim. The Plaintiff was injured in November of 2011 while working on the job, and although she was still physically unable to work a month later, she was terminated after repeatedly failing to update her employer on her status. The Plaintiff argued that she had indeed reported to the company and claimed she had cell phone records of approximately 30 phone calls to her employer within the month. [Read more...]
Hartline Dacus Barger Dreyer LLP successfully defends trucking company accused of hit and run. - ALVARADO, Texas, August 18, 2014. Hartline Dacus Barger Dreyer LLP attorney Edward A. Davis secured a verdict for a major trucking company in a jury trial alleging a hit and run accident in Alvarado, Texas. The Plaintiff sued the trucking company, claiming that she sustained personal injuries and damages to her car after being run off the road by one of the company’s salt water disposal tankers. She further argued that the accident was due solely to the negligent actions of the rig driver. [Read more...]
HDBD defends a property management company in a two-week jury trial ending with a complete defense verdict. – August 20, 2013 (Dallas, Texas). HDBD attorneys Darrell Barger and Kristina Culley secured a defense verdict for a property management company after a two week trial in Houston, Texas. Two residents of an apartment complex were killed when a fire broke out and engulfed the building. The Plaintiffs alleged that the smoke alarms were not functioning properly and the emergency box at the gate entrance was in disrepair, delaying the firefighters.
After Barger and Culley presented a strong defense to these allegations, the jury returned a verdict which cleared the property management company of any negligence, and placed full responsibility for the death of both victims on the woman who started the fire.
HDBD successfully defends Nissan Forklift Corporation in a jury trial involving a complex dealership agreement dispute. – August 2, 2013 (Dallas, Texas). HDBD attorneys Jeff Patterson and Adrienne Russell successfully defended a manufacturing company in a jury trial in St. Louis, Mo., in a case involving the termination of a dealership agreement. Many claims were invalidated early in litigation, and the sole issue for trial was whether Defendant had “good cause” to terminate, cancel, or not renew the dealer agreement. Patterson and Russell argued that statutory good cause existed due to ADL’s failure to comply with the reasonable requirements of their agreement, which were imposed consistently on similar dealers. Plaintiff was asking for $2.4 million, but after Defense Counsel demonstrated that Plaintiff suffered no harm or lost profits, the jury returned a defense verdict and no damages were awarded.
HDBD achieves defense verdict for trucking company in jury trial involving a high-speed crash between an 18-wheeler and an SUV. – May 22, 2013 (Dallas, Texas). HDBD attorneys Darrell Barger, Brian Rawson, and Stephanie Roark successfully defended a trucking company and one of its drivers in a three-week jury trial in Cleburne, Texas. The case involved a high-speed crash between the company’s 18-wheeler and the Plaintiffs’ SUV. Plaintiffs’ counsel called more than 25 witnesses in an attempt to prove the defendants’ negligence and asked the jury to award more than $21 million dollars in damages to Plaintiffs. After brief deliberations, the jury returned a verdict barring the primary Plaintiff from recovery and severely limiting his passenger’s recoverable damages. [Read more…]
Bridgestone Americas Receives Defense Verdict in Jury Trial Defended by HDBD Partner Scott Edwards – February 22, 2013 (Dallas, Texas). Scott Edwards and his co-counsel successfully defended Bridgestone Americas Tire Operations, LLC in a four-week jury trial in Nashville, TN earlier this year. The driver of a 1998 Ford Explorer suffered fatal injuries in a single vehicle accident in Mexico in which the vehicle’s left rear tire allegedly sustained a tread/belt detachment. The driver failed to maintain control of the vehicle causing it to leave the roadway and overturn. The plaintiffs claimed that the subject tire was defective. Plaintiffs also sued Ford Motor Company, alleging negligence in the design of the Explorer and in equipping the vehicle with the Firestone tire.
At trial, Bridgestone Firestone presented evidence that the tire was not defective and failed as a result of being punctured, improperly repaired, and operated in a damaged condition for a significant period of time. The defense further argued that the driver was negligent for operating his vehicle with the damaged tire and for driving at an excessive rate of speed. The jury returned a unanimous defense verdict.

Hartline Dacus Barger Dreyer LLP Attorneys Achieve Dismissal of Class Action Lawsuit – July 20, 2012 (Houston, Texas). Hartline Dacus Barger Dreyer LLP attorneys, Richard Crews, Jeff Cox, and Roy McKay aggressively defended their clients in a class action lawsuit involving the King’s Crossing subdivision and the development of a golf course. Last month, Richard Crews questioned the plaintiff’s ability to represent the class action suit and filed a motion to show authority. Increasing the stakes, he also filed counterclaims against the plaintiffs, seeking recovery of attorney’s fees, both with respect to defending the class action suit and the individual claims.
As a result, the plaintiffs filed a nonsuit on their claims which prevented any further refilling. Jeff Cox and Roy McKay assisted Mr. Crews by setting up protective orders that made the case very difficult for the plaintiffs to move forward. There are related cases that stem from the original, but this dismissal concludes the most dangerous portion of the claims for the firm’s clients.
