HDBD Attorneys Persuade Texas Court of Appeals to Send Civil Damage Claims to Arbitration

Hartline Dacus Barger Dreyer attorneys Brian Rawson, Stephanie Roark, and Roy McKay successfully petitioned on appeal for civil damage claims against the firm’s client, a publicly-traded hospitality company, to be moved to arbitration. Arguing to Texas’ Fifth Court of Appeals, HDBD attorneys moved to compel arbitration citing a provision in a lease agreement the plaintiff signed stating that any dispute arising from “working at the [establishment]” would be decided by binding arbitration. Although a trial court originally denied the motion to compel arbitration, a three-judge panel on the Texas Court of Appeals court reversed the lower court’s decision.
